# Intellectual property monitoring & enforcement

**Domain:** [Legal, Compliance & Risk](https://www.thestateofplay.ai/domain/legal-compliance) · **Tier:** Leading Edge · **Trend:** Steady

AI that monitors for intellectual property infringement including trademark violations, patent infringement, and counterfeit goods. Includes marketplace monitoring and image-based infringement detection; distinct from patent analysis which researches the landscape rather than monitoring for violations.

## Overview

AI that watches marketplaces, social platforms, domains and imagery for trademark abuse, counterfeits and infringement of intellectual property, then drives takedowns, matters to any brand whose goods or name circulate online. It is a leading-edge practice, steady, because production tooling, analyst attention and marketplace-reported results are plentiful, yet adoption stays confined to specialist brand-protection teams. The tension is reliability rather than reach. False positives erode trust with platforms, image-based authentication still leans on human inspectors, enforcement needs legal escalation across fragmented jurisdictions, and the takedown mechanism itself can be abused. Until independent buyer-side results show measurable returns and use spreads into general enterprise intellectual property operations, detection will keep outrunning enforcement.

## Current Landscape

Marketplaces now remove most infringing listings before rights holders complain. Alibaba International's 2026 IP protection report says AliExpress's AI-based BrandSafe programme removed infringing listings at roughly 9x the volume of rights-holder notice-and-takedown requests, up from about 4.5x a year earlier. For Korean rights holders the ratio was 17x. It adds that 94% of proactively removed listings were deleted before a single sale. Temu reports a 331:1 proactive-to-reactive removal ratio across 15,000+ monitored brands. Amazon's 2024 Brand Protection Report states that proactive controls blocked more than 99% of suspected infringing listings before a brand had to report them.

Specialist vendors compete on marketplace coverage and named customer outcomes. MarqVision reports 99%+ accuracy across 1,500 marketplaces for K-beauty brands, as well as 15-minute detection for live-sports piracy. Podqi counts Wu-Tang Clan, Warner Bros and NBCUniversal as entertainment customers. It reports a 1.9-day median resolution for Madhappy and $1.62M blocked for Jones Road Beauty. Red Points reports 4.3M detections in 2024 across 1,300+ brands. Acviss's comparison page credits Corsearch with 10M+ listings removed annually and 200+ Fortune 500 clients. Corsearch has also acquired Courtemis to add enforcement case management.

Physical and upstream authentication extends detection beyond online listings. Entrupy reports 99.86% accuracy in luxury authentication but an 8.1% unidentified rate. Its State of the Fake Report 2026 cites $3.7B worth of goods processed. SECUR3D's Sentry detects unauthorised use across 22 marketplaces from 25,000+ fingerprinted assets, and its AssetSafe screens content at upload. Acviss sells a suite that pairs physical product authentication with Truviss marketplace monitoring, and it claims 3.5+ billion products secured across 143+ brands.

Governments are building AI enforcement into state infrastructure. South Korea removed 210K+ infringing items in 2025 and plans state-backed trademark authentication by October 2026. Korea Customs intercepted about 450,000 IP-infringing items in a special crackdown between May 4 and June 30, 2.5x the same period a year earlier. China's government-backed Wuweizhibiao platform applies AI to trademark enforcement. EUIPO has launched an AI early screening tool for pre-filing trademark conflict checks. New Russian marketplace rules require integration with Rospatent to support proactive IP verification.

Forecasts and surveys point to rising spend, driven by the threat. Ken Research sizes Southeast Asian brand protection software at USD 58 Mn in 2025, rising to USD 159 Mn by 2032 at a 15.50% CAGR. It names marketplace monitoring and takedown as the fastest-growing segment. Ennoventure puts anti-counterfeiting technology at $173.79B, rising to $408.83B at a 12.6% CAGR. Corsearch's State of Trademarks 2026 survey finds that 37% plan to adopt AI monitoring or enforcement tools within 12 months. A Q1 2026 threat report found AI-driven brand threats grew 16x year on year, with fake websites up 47x.

Self-serve tooling is bringing enforcement within reach of small brands. iTechGuides' review of Brand Protector lists pricing of $199/month or $1,499/year for unlimited takedowns across 16 supported surfaces. Every filing passes human review and a triple-validation approval gate. LibauTech's buyer's guide notes that Katcher scans for free and charges $75 per takedown notice, but does not yet monitor marketplaces. The enterprise suites it reviews are demo-and-quote only. The guide also cites Netcraft's median phishing takedown of about 33 minutes.

Detection accuracy remains the weak point, and vendor claims are hard to verify. An independent comparison of trademark and brand-safety scanners documents false positive rates of 40%. AIVISION's deployment engineers report that over 30% of recognition errors in a lubricant project came from warranty labels misaligned by a few millimetres. They warn against 99% accuracy claims made without dataset disclosure. They advise 4–6 week pilots that target false positives under 2–3%, because staff stop acting on alerts once false alarms dominate.

Detection does not translate automatically into removal. Amazon requires brands to hold an acceptance rate of at least 90% on its Report a Violation tool to enrol in Project Zero. Enrolled brands must then keep 99% accuracy on the listings they remove themselves. The autopilot.law analysis calls unauthorised resale of genuine stock, misfiled as counterfeiting, the most expensive and most common cause of rejection. Instagram's copyright-strike system has been exploited by extortionists who file false claims and then demand ransoms of USD 50-900.

Generative AI is widening the gap between threat creation and enforcement. Content that confuses buyers about a brand, which once took a design team, can now be produced in minutes, faster than detection and removal can keep up. IPWatchdog argues that AI purchase agents undermine the likelihood-of-confusion doctrine, because machines choosing on data are not confused by marks. Stanford Law School's Algorithmic Couture analysis finds that the legitimacy of algorithmic enforcement depends on explainability, auditability, human oversight and rule-of-law compliance across the EU, US and China.

The remaining blockers are organisational rather than technical. Enforcement still needs human judgement to separate counterfeits from authorised resellers, grey-market goods and legitimate reuse. It also depends on registrar relationships and legal escalation. Threats span 118+ countries and 1,500+ platforms, which fragments jurisdiction. Practitioners say defensible use requires documented tool limitations, and that weaker performance on non-Latin scripts creates malpractice exposure. Adoption therefore remains concentrated in the specialist teams of large enterprises.

## History

- **2026-Sep:** Production-scale enforcement metrics accumulated across named deployments: an anti-phishing platform monitoring 1.3 billion domains reported 5.3-hour median takedown with registrar/hosting-provider and Meta Trusted Reporting integration, Temu's proactive-to-reactive removal ratio reached 331:1 across 15,000+ protected brands (60% YoY increase, named customers Levi Strauss and Maersk), and a D2C brand's AI keyword-monitoring deployment showed a 20x detection increase and measurable CPA reduction. China's government-backed Wuweizhibiao platform reported 500+ infringement leads and a named cross-border US enforcement win (Ty Inc., February 2026). Reliability limits persisted alongside the scale gains: UC Riverside research documented Gemini 3.6 Flash both correctly flagging and falsely flagging cosmetic counterfeits, and practitioner analysis identified evidence documentation — not detection — as the binding enforcement bottleneck, with AI-assisted frame analysis cutting evidence-assembly time from 2-5 days to under an hour. Additional named deployments confirmed continued scale: publicly-traded SECUR3D (CSE: SRD) disclosed 25,000+ fingerprinted assets and 22-marketplace coverage across its AssetSafe/Sentry platforms, Temu's Local Seller Program showed an SMB (Pluginz) benefiting from its 331:1 proactive-to-reactive enforcement ratio, and a Matellio case study documented an AWS Bedrock/Claude Sonnet trademark risk-analysis deployment cutting attorney review time 40-50%. Market sizing (Reed Intelligence) projected growth from $2.85B to $7.24B by 2034. A countervailing reliability signal emerged: BBC investigation found Instagram's copyright-strike system unverified by Meta, enabling extortionists to file false claims and demand cryptocurrency ransoms — exposing enforcement-automation fraud risk at platform scale. AliExpress's BrandSafe proactive removal ratio rose to roughly 9x rights-holder requests globally (17x for Korean brands, 94% pre-sale), while practitioners countered that accuracy, not volume, now gates enforcement: Amazon Project Zero requires 90% acceptance and 99% self-removal accuracy, and engineers reported over 30% of recognition errors from label misalignment, confirming human review remains load-bearing.
- **2026-Aug:** Vendor ROI reporting matured with named customer metrics — Podqi disclosed Madhappy's 1.9-day median takedown and Jones Road Beauty's $1.62M blocked, with brands reporting 2–5% revenue impact — alongside market growth projections (IP management software $15.2B to $26.2B by 2031, 11.5% CAGR) and Red Points' expansion of Vision AI detection to Temu, Shein, and TikTok Shop against a $467B counterfeit market. Stanford Law's cross-jurisdictional analysis of algorithmic trademark enforcement legitimacy across the EU, US, and China, alongside documented LLM-hallucination risk (34% of AI-suggested login URLs are fake, per Netcraft), sharpened scrutiny of enforcement-AI reliability even as Clarivate expanded multi-modal dispute-assessment automation. Later-month evidence reinforced both the scale and the reliability tension: South Korea launched a state-backed AI enforcement program (210K+ items removed in 2025, government-certified trademark registration across 70+ countries by October 2026), Temu's proactive-to-reactive enforcement ratio rose to 331:1 across 15,000+ brands, and MarqVision deployed sub-90-minute live-sports piracy detection targeting a $28B annual loss category. Countervailing signals hardened: independent trademark-scanning comparisons documented 40%+ false-positive rates at usable precision thresholds, Entrupy's luxury authentication returned "unidentified" on 8.1% of items despite 99.86% accuracy (Louis Vuitton fake rate 33%), and IP commentators argued AI purchase agents may structurally undermine likelihood-of-confusion doctrine as AI (not humans) increasingly evaluates products.
- **2026-Jul:** Competitive platform benchmarking confirmed divergent enforcement architectures at scale: Podqi (99.8% image-match accuracy, 48-hour Shopify removal) and MarqVision (99%+ accuracy, 94%+ SKU-matching, 15-minute MTTR, 1,500+ marketplace coverage) both report six-figure customer bases while targeting different market segments (US D2C vs APAC global), and MarqVision's post-Series-B organizational scaling (30+ open roles across Seoul, Shanghai, Tokyo) signals sustained investment in production deployment. Clarivate's GA of a dedicated AI trademark watch analyzer within its enterprise IPfolio platform marks adoption by a legacy IP data vendor, while market projections ($966M in 2026 growing to $4.64B by 2035 at 21.67% CAGR) and the documented shift from reactive periodic scanning to 24/7 continuous surveillance confirm the monitoring category's consolidation. Production enforcement scale climbed further — Red Points reported 70M links processed daily with 5.1M enforcements annually across 1,300+ brands, MarqVision disclosed 60M infringements actioned in 2025 at 99.1% removal across 1,500+ channels, and Temu scaled proactive enforcement to 15,000+ brands with a 331:1 proactive-to-reactive ratio — while critical commentary cautioned that platform delisting alone does not stop counterfeiters, who re-enter under new accounts absent offline intervention such as customs seizure or prosecution.
- **2026-Jun:** Ecosystem consolidation and reliability fragmentation advanced in parallel. Corsearch acquired Courtemis case management (serving Lacoste, Gant, Aigle, Tecnifibre) to consolidate detection and enforcement into an integrated IP Intelligence Hub, signalling vendor maturation toward full-lifecycle platforms. Russia's Marketplace Economy Law (effective Oct 1, 2026) mandates proactive Rospatent registry integration at point of listing, adding regulatory infrastructure to monitoring demand. Critically, an independent Aimclear study of five AI systems across 47,557 pages found Claude Sonnet 4.6 misattributed trademarks to rival companies in 8.2% of queries, while Gemini and Perplexity achieved 94-97% accuracy — confirming that vendor AI choice materially determines enforcement reliability and that AI-driven monitoring requires vendor-specific due diligence.
- **2026-May:** Threat volume and enforcement scale both accelerated sharply. MarqVision's Q1 2026 metrics documented 16x YoY growth in AI-driven brand threat detections and 47x growth in fake website detections across 1,500+ monitored platforms in 118+ countries, confirming that AI-generated counterfeiting and impersonation are outpacing linear enforcement capacity. Countervailing deployment signals: a K-beauty brand case study achieved 99%+ detection accuracy with enforcement 180x faster than manual across the same 1,500+ marketplace footprint, and MarqVision's Korean deployment validated 80% detection time reduction and 12-18 month ROI breakeven. The EUIPO deployed an AI-powered pre-filing trademark screening tool for conflict detection, marking another government IP office adopting AI-assisted examination alongside human review.
